1. About these terms

These terms and conditions ("these terms") set out the basis on which Bright Bound Education makes this website available to you and provides its services. They apply to everyone who uses this website, submits an enquiry through it, or works with us as a learner, an employer, a provider or a partner.

By using this website or contacting us through it, you accept these terms. If you do not accept them, please do not use the site.

These terms do not affect your statutory rights.

2. Who we are

Bright Bound Education ("Bright Bound", "we", "us", "our") is an education partnership organisation based in London, United Kingdom. We work across three areas: education partnerships, learner recruitment and workforce development.

We are not registered for VAT.

3. What we do — and what we do not do

We provide information, guidance and introductions. We help people identify education and training that suits their circumstances, we help them prepare and submit applications to providers, and we help education providers and employers reach suitable learners.

We are not an education provider, a college, a university or an awarding organisation. We do not deliver courses, we do not teach, we do not assess and we do not award qualifications. All teaching, assessment, certification and student support is delivered by the provider you apply to, under that provider’s own terms.

Any contract to study is between you and the provider. We are not a party to it.

4. No guarantee of a place, funding or outcome

Decisions about admission, entry requirements, eligibility and funding are made solely by the relevant university, college, training provider or funding body. We have no control over those decisions and we cannot influence them.

Accordingly, nothing on this website and nothing said by us amounts to a promise or guarantee that:

• you will be offered a place on any course;
• you will be found eligible for any course, programme or funding;
• any course will run, or will run at a particular time, location or price;
• you will achieve any qualification, grade or result; or
• you will obtain employment, an apprenticeship or any other outcome following a course.

Any indication we give about your likely prospects is our opinion based on the information available to us at the time. It is not a commitment.

5. Course information, fees and locations

Course titles, levels, content, entry requirements, fees, start dates and delivery locations shown on this website are set by the providers we work with, not by us. They are indicative and can change, be withdrawn or be fully subscribed at any time without notice to us.

We take reasonable care to keep the information on this website accurate and current, but we do not warrant that it is complete, accurate or up to date. Before you commit to a course you should confirm the details directly with the provider.

Any fees payable for a course are payable to the provider under the provider’s own terms, and any questions about fees, funding, refunds or withdrawal are matters for that provider.

6. Our service is free to learners

We do not charge learners for our service. We do not ask learners for payment at any stage, and we will never ask you to pay us a fee, deposit or administration charge in order to access a course, an application or an introduction. Where we are remunerated, it is by the education providers and employers we work with.

If anyone claiming to represent Bright Bound asks you for money, please do not pay it and contact us immediately at info@brightbound.co.uk.

7. Information you give us

When you enquire or apply through us, you agree that the information and documents you give us are true, accurate, complete and your own, and that you have the right to provide them.

We rely on what you tell us when we advise you and when we submit anything on your behalf. We are not responsible for the consequences of information that is inaccurate, incomplete or out of date, including an application being rejected or withdrawn.

We may stop acting for you, and may inform the relevant provider, if we have reasonable grounds to believe that information or a document you have given us is false, forged or misleading.

8. Documents you upload

Where this website allows you to upload documents, you must only upload documents relating to your own application, or an application you are authorised to make. You must not upload anything unlawful, malicious or infringing.

We handle uploaded documents in accordance with our Privacy Policy. We take reasonable steps to keep them secure, but no transmission over the internet can be guaranteed to be completely secure, and you upload at your own risk.

9. Partner and agent registrations

Registering an interest through this website — including through the Agent Register page — is an expression of interest only. It does not create a partnership, agency, joint venture or employment relationship between us, and it does not entitle you to represent Bright Bound or to any commission or payment.

Any working relationship begins only when it is confirmed by us in a separate written agreement, and that agreement will govern the relationship in place of these terms.

You must not hold yourself out as an agent, representative or partner of Bright Bound, or use our name or logo, unless we have agreed in writing that you may.

10. Acceptable use of this website

You may use this website for lawful purposes connected with our services. You must not:

• use the site in any way that breaches any applicable law or regulation;
• submit false, misleading or fraudulent enquiries, or enquiries on behalf of someone who has not asked you to;
• send spam, bulk or automated submissions through our forms;
• scrape, harvest, copy or systematically extract content or data from the site;
• attempt to gain unauthorised access to the site, its server, or any connected system;
• introduce any virus, malware or other harmful material; or
• use the site in a way that could damage, disable or impair it, or interfere with anyone else’s use of it.

We may suspend or withdraw access to the site, or to our services, without notice where we consider it necessary.

We do not guarantee that this website will always be available or uninterrupted. We may suspend, withdraw or change all or part of it without notice.

11. Intellectual property

All content on this website — including text, layout, design, graphics, photographs and the Bright Bound name and logo — belongs to us or is used by us under licence, and is protected by copyright and other intellectual property laws.

You may view, download and print pages from the site for your own personal or internal business use in connection with our services. You must not otherwise copy, reproduce, republish, distribute or commercially exploit any part of it without our written permission.

12. Links to other websites

This website may link to websites operated by universities, colleges, training providers and other third parties. We provide those links for convenience only. We do not control those websites, we do not endorse them, and we are not responsible for their content, their accuracy or their handling of your data.

13. Our liability to you

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.

Subject to that:

• the information on this website is provided for general guidance and is not professional, legal, financial or immigration advice, and you should not rely on it as such;
• we are not liable for the acts, omissions, decisions or performance of any education provider, employer, awarding organisation or funding body;
• we are not liable for any loss of profit, loss of opportunity, loss of earnings or any indirect or consequential loss, however arising; and
• we are not liable for any failure or delay caused by events outside our reasonable control.

Where we are found liable to you, and to the extent the law allows us to limit that liability, our total liability arising out of or in connection with these terms and our services is limited to £500.

If you are a consumer, these limits apply only so far as it is fair and reasonable for them to do so, and they do not affect your statutory rights.

14. Privacy and data protection

We handle personal information in accordance with the UK General Data Protection Regulation and the Data Protection Act 2018. Our Privacy Policy explains what we collect, why we collect it, who we share it with, how long we keep it and the rights you have. It forms part of these terms.

15. Complaints

If you are unhappy with anything we have done, please tell us. Email info@brightbound.co.uk with the word “Complaint” in the subject line, or write to us at the address above, and set out what happened and what you would like us to do.

We will acknowledge your complaint and respond as promptly as we reasonably can.

A complaint about the delivery of a course, about teaching, assessment or a qualification, should be raised with the provider concerned under that provider’s own complaints procedure.

16. Changes to these terms

We may update these terms from time to time to reflect changes in our services or in the law. The version published on this page is the version that applies, and the date it was last updated is shown at the top of the page. Please check it when you use the site.

17. Governing law

These terms, and any dispute arising out of or in connection with them, are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident elsewhere in the United Kingdom you may also bring proceedings in the courts of the part of the UK in which you live.
